This SOP provides a detailed outline of the steps for creating and submitting an E-Verify case directly on the E-Verify website (no HRIS). It's important for employers to confirm their state's specific rules as they can evolve over time. Always check local state government resources or contact your HR Account Manager for questions and specific guidance.
As of now, the following states require employers to use E-Verify for all or certain new hires:
- Alabama
- Arizona
- Mississippi
- South Carolina
- Utah
Some other states have partial or conditional requirements, such as:
- Georgia: Requires E-Verify for employers with more than 10 employees.
- North Carolina: Requires E-Verify for all employers with 25 or more employees.
Several other states may mandate E-Verify for public contractors or those doing business with the state.
This SOP assumes that the I-9 Sections 1 and 2 are completed for the respective employee prior to initiating the E-Verify process.

Select the appropriate Citizenship Status for the employee. Press Continue. |

Select the applicable documents provided by the new hire. These are the same documents that were used to complete Section 2 of the I-9. |

Fill in the respective details for each of the chosen documents. If submitting a Passport, you will be required to confirm that the passport photo matches the photo displayed in E-Verify. |

Select the employee's first day of employment. E-Verify must be completed no later than the employee's third day of employment. If submitting after the employee's third day of employment, E-Verify will prompt you for a reason for late submission. |

Additional Information / FAQ |
Once submitted , the result of the case will be displayed .
- Once case is cleared and no further action is required, save the case results to the employee's I-9 documents tab in isolved.
- If further review is flagged by the USCIS department, the HR associate (if applicable) will provide the Client with additional steps required. The Client will follow up with the employee.
- If applicable, the HR Associate will follow up with the Client routinely to check the status of the case.
- Employees have 14 days to address any corrections that are required for the E-Verify case to be completed.
- Once steps are completed by the employee, go to the E-Verify site under Cases with Updates and select Continue Case. Follow the prompts.

- What is E-Verify?
- E-Verify is an online system that allows employers to verify the employment eligibility of their employees by comparing the information from the I-9 form with records available to the Department of Homeland Security (DHS) and the Social Security Administration (SSA).
- Is participation in E-Verify mandatory for employers?
- It depends on the employer. While it’s mandatory for employers in some states or industries, it’s voluntary for others. Employers in certain federal contracts are also required to use E-Verify.
- How does E-Verify work?
- Employers submit the information provided on the I-9 form into the E-Verify system. The system then checks the data against government records to confirm that the employee is authorized to work in the U.S. The employer receives a result (either "Employment Authorized" or "Tentative Nonconfirmation") within seconds.
- What should an employer do if E-Verify returns a "Tentative Nonconfirmation" (TNC)?
- If an employee receives a TNC, the employer must notify the employee and provide instructions on how to resolve the issue. The employee will need to contact the SSA or DHS to clear up any discrepancies. The employer must not take any adverse action against the employee while they are resolving the issue.
- What is the difference between the I-9 and E-Verify?
- The I-9 form is required for all employers to verify an employee’s identity and work authorization. E-Verify is an additional step that employers can take (or may be required to take, depending on their industry or contracts) to electronically verify an employee's work eligibility with government databases.
- Can an employer use E-Verify before an employee starts working?
- No. Employers must complete the I-9 form, including Section 1 and Section 2, before using E-Verify. E-Verify can only be used after the employee has been hired.
- Is E-Verify free?
- Yes, E-Verify is a free service provided by the U.S. government to help employers confirm the eligibility of their employees to work in the U.S.
- How long does an E-Verify case result take?
- The E-Verify process is usually completed in seconds, but in some cases, it may take up to 24 hours to get a result. If a discrepancy is found, additional steps may be needed to resolve the issue.
